Welcome to CV Optimisation. These Terms of Service ("Terms") govern your access to and use of our website, application, and services (collectively, the "Service"). Please read these Terms carefully before using the Service.

1. Description of Service

CV Optimisation is a web-based platform that helps users create, optimise, and manage their CVs (curriculum vitae/resumes). Our Service includes:

• CV upload, parsing, and storage
• AI-powered CV analysis and recommendations
• ATS (Applicant Tracking System) compatibility scoring
• Guided worksheets for CV improvement
• Learning modules on CV best practices
• CV tailoring for specific job descriptions
• CV export in multiple formats (PDF, Word, TXT)
• AI chatbot assistance

2. Beta Programme

The Service is currently in beta testing. By participating in our beta programme, you acknowledge and agree that:

• The Service may contain bugs, errors, or incomplete features
• Features may be added, modified, or removed without notice
• The Service may experience downtime or interruptions
• Your feedback may be used to improve the Service
• Beta access is provided at our discretion and may be revoked at any time
• Beta pricing or free access may change when the Service exits beta

We appreciate your participation in helping us improve the Service. Your feedback is valuable and helps shape the future of the platform.

3. Account Registration

To use certain features of the Service, you must create an account. When creating an account, you agree to:

• Upload content that infringes on intellectual property rights of others
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorised access to the Service or other users' accounts
• Use automated systems (bots, scrapers) to access the Service without permission
• Interfere with or disrupt the Service or servers
• Share your account credentials with others
• Resell, sublicense, or redistribute the Service
• Use the Service for any illegal or unauthorised purpose
• Violate any applicable laws or regulations

5. Your Content

5.1 Ownership

You retain all ownership rights to the content you upload or create using the Service, including your CVs, worksheet responses, and other materials ("Your Content"). We do not claim ownership of Your Content.

5.2 Licence to Us

By uploading or creating content on the Service, you grant us a limited, non-exclusive, worldwide licence to use, store, process, and display Your Content solely for the purpose of providing and improving the Service. This licence ends when you delete Your Content or your account.

5.3 Your Responsibilities

You are solely responsible for Your Content and represent that you have all necessary rights to upload and use it. You agree that Your Content does not violate any third-party rights or applicable laws.

6. Intellectual Property

The Service, including its original content, features, functionality, design, and branding (excluding Your Content), is owned by CV Optimisation and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

7. AI-Generated Content

Our Service uses artificial intelligence to provide suggestions, analysis, and generated content. Regarding AI-generated content, you acknowledge and agree that:

• AI suggestions are recommendations only and may not be accurate or suitable for your specific situation
• You are responsible for reviewing and editing all AI-generated content before use
• AI outputs should not be relied upon as professional career advice
• We do not guarantee any specific outcomes from using AI features
• You retain responsibility for the final content of your CV
• Our AI features are powered by Anthropic's Claude. Your CV content is processed by this service to provide analysis and suggestions.

8. Payment Terms

Certain features of the Service may require payment. If you purchase a paid plan:

• You agree to pay all fees associated with your selected plan
• Payments are processed securely through our payment provider
• All fees are quoted and charged in the currency displayed at checkout
• We reserve the right to change pricing with reasonable notice
• Refunds are handled in accordance with our refund policy

During the beta period, special pricing or free access may be offered. These offers are subject to change when the Service exits beta.

Refund Policy: If you are not satisfied with the Service, you may request a refund within 14 days of purchase, provided you have not downloaded or exported a completed CV. Refund requests should be sent to support@cvoptimisation.io. After 14 days, or once a CV has been downloaded or exported, refunds are not available.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
• WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF AI-GENERATED CONTENT
• WARRANTIES THAT THE SERVICE WILL RESULT IN JOB INTERVIEWS OR EMPLOYMENT

We do not guarantee that using our Service will result in job interviews, job offers, or career advancement. Success depends on many factors beyond our control.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CV OPTIMISATION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from your use or inability to use the Service
• Damages arising from any content or conduct of third parties
• Damages arising from unauthorised access to your account or data

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim, or £100, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless CV Optimisation and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) Your Content.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• Request by you to delete your account
• Discontinuation of the Service

Upon termination, your right to use the Service will immediately cease. You may request export of Your Content before termination. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, and limitations of liability.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

14. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of England and Wales.

15. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
• Waiver: Failure to enforce any provision of these Terms does not constitute a waiver of that provision.
• Assignment: You may not assign or transfer your rights under these Terms without our consent. We may assign our rights without restriction.
